Mandla Mandela has been accused of relocating the remains of three of the ailing former leader's children from Qunu, South Africa, where the civil rights icon grew up, to Mvezo, where Nelson was born, without seeking permission from his relatives.
As the 94-year-old former president remained hospitalised in critical condition with a lung infection on Tuesday (02Jul13), 16 of his family members won a court order to have the bodies of Makgatho, Thembekile and Makaziwe returned to their original resting places.
During the hearing, Mandla was also formally charged in the alleged 2011 incident.
Eastern Cape police spokesman Mzukisi Fatyela tells Reuters, "We have started our investigation and we will send the case to the senior prosecutor for a decision on whether to prosecute or not."
Makgatho, Mandla's father, passed away from AIDS-related diseases in 2005, while Thembekile was killed in a 1969 car crash and Makaziwe died as an infant in 1948.
